Public Utilities Commission Alternative Regulation

Alternative Regulation

Elective Alternative Regulation

Under rule 4901:1-4, Ohio Administrative Code as originally promulgated pursuant to Case No. 00-1532-TP-COI, an Incumbent Local Exchange Carrier (ILEC) can file for increased regulatory flexibility for competitive services other than Basic Local Exchange Services.  The Opinion and Order and Entry on Rehearing below outline the requirements for these applications.

Basic Local Exchange Service Alternative Regulation

In Case No. 05-1305-TP-ORD, the Commission revised 4901:1-4 Ohio Administrative Code.  Under this revision, a large Incumbent Local Exchange Carrier who has qualified for Elective Alternative Regulation, and can demonstrate effective competition for Basic Local Exchange Services, may apply for additional regulatory flexibility to be applied to Basic Local Exchange Services, on an exchange-by-exchange basis.

Elective Alternative Regulation for Small Local Exchange Carriers

In Case No. 05-1304-TP-ORD the Commission revised 4901:1-4 Ohio Administrative Code.  Under this revision, small Incumbent Local Exchange Carriers may apply for Elective Alternative regulation, under a slightly adjusted structure from that applied to large Incumbent Local Exchange Carriers.  The Finding and Order below outlines the requirements for these applications.

Alternative Regulation for Not-For-Profit Local Exchange Carriers

In Case No. 05-1303-TP-ORD the Commission revised the regulatory requirements originally placed on small Incumbent Local Exchange Carriers in Case No. 89-564-TP-COI.  Under this revision, small Not-For Profit Incumbent Local Exchange Carriers are subject to a simplified Alternative Regulation process.  The Finding and Order below outlines this process.
